General Terms and Conditions (GTC)

for the use of offers from the Qigong Institute Switzerland

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all bookings and purchases via the website http://www.qigong-institut.ch , in particular for:
• Online live courses (via Zoom or similar),
• Downloadable learning videos (video on demand),
• On-site seminars and classroom courses.
1.2 Deviating or additional terms and conditions of the customer do not apply unless they have been expressly accepted by us in writing.

2. Provider information

2.1 The provider of the services is:

3. Conclusion of contract

3.1 The presentation of courses and products on our website does not constitute a legally binding offer, but a non-binding invitation to make a booking.
3.2 By submitting the booking, the customer makes a binding contractual offer.
3.3 The contract is concluded through our declaration of acceptance, usually through a booking confirmation via email.

4. Description of Services

4.1 The services offered include online Qigong courses (live participation), digital learning materials, and physical presence courses.
4.2 The scope of services, content, dates, venue, and technical requirements are bindingly presented in the respective course descriptions on our website.
4.3 For digital products, the service begins with the provision of access.

5. Prices and Terms of Payment

5.1 All prices are in Swiss francs (CHF), unless otherwise stated, and include statutory VAT.
5.2 Payment is made using the payment method specified during the ordering process (e.g., advance payment, credit card, PayPal).
5.3 The right to participate only arises after full payment has been received.

6. Right of withdrawal and cancellation

6.1 For digital content (e.g., learning videos) that is made available immediately, the right of withdrawal expires upon commencement of use, provided the customer has expressly agreed to this provision during the booking process.
6.2 For online or in-person seminars, we voluntarily grant a right of withdrawal of 14 days, provided the event has not yet begun.
6.3 Cancellations of in-person seminars are possible up to 30 days before the start of the event for a processing fee of CHF 30.
6.4 For cancellations from the 29th day up to 7 days before the start of the course, the cancellation fee is 50% of the course fee.
6.5 In the event of later cancellation or no-show, the full course fee is due.
6.6 A substitute participant can be named after consultation.

7. Conditions of Participation

7.1 Participation is at your own risk. The courses are intended for relaxation, health promotion, and personal development and are not a substitute for medical or psychotherapeutic treatment.
7.2 Persons with physical or mental limitations are recommended to seek medical advice before participating.

8. Liability

8.1 We are only liable in cases of intent and gross negligence.
8.2 In cases of slight negligence, our liability is only for the breach of essential contractual obligations (cardinal obligations) and is limited to typical, foreseeable damage.
8.3 No liability is accepted for indirect damage, consequential damage, or lost profit.
8.4 The use of online platforms (e.g. Zoom) is at your own technical risk.

9. Data protection

9.1 The collection, processing, and use of personal data is carried out in accordance with our privacy policy.
9.2 Data will only be used within the framework of legal requirements and for contract fulfillment. Data will only be passed on to third parties if this is necessary for processing.

10. Changes to the Terms and Conditions

10.1 We reserve the right to adapt these Terms and Conditions at any time with future effect. Changes will be announced on the website.
10.2 The current version of the Terms and Conditions can be viewed at http://www.qigong-institut.ch .

11. Final Provisions

11.1 The law of the Swiss Confederation applies exclusively.
11.2 The place of jurisdiction is Baar, unless mandatory legal provisions conflict.
11.3 Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid clause will be replaced by a legally permissible provision that comes as close as possible to the economic purpose.
